Practice Areas: Worker's Compensation

The Michigan Workers' Disability Compensation Act requires that virtually all Michigan employers must have insurance to cover an employee who suffers an "injury arising out of and in the course of employment."

Workers injured while on the job are entitled to collect their wage loss, medical care, and rehabilitation expenses.

Michigan law is very complicated regarding workers' compensation. The general rule is that an injured worker is entitled to collect 80% of after-tax wages. Wages are usually determined to be the average salary of the highest paid 39 of the last 52 weeks. Depending on the seriousness of the injury, workers may be entitled to compensation for years to come or perhaps for the rest of their lives. However, time is always of the essence.
