Practice Areas: Nursing Home Injury

One of the worst types of malpractice in existence occurs when an elderly person falls victim to nursing home neglect. Recent studies indicate that elderly people are at a far greater risk of not being cared for properly than their loved ones could possibly imagine.

There are currently between 1.5 million to 2 million elderly people in nursing homes in the United States. It is estimated that about 2% of people in nursing homes are being neglected. That means there are an estimated 15,000 elderly people in nursing homes being neglected.

Shockingly, one survey shows that about 30% of people would rather die than live in a nursing home.

Nursing home neglect includes:

  • Utterly neglecting residents of a nursing homes
  • Failing to provide sufficient food and water
  • Failing to treat bedsores
  • Failing to prevent other ailments
Nursing home neglect causes physical pain and suffering and often death to the elderly person falling victim to the neglect and psychological harm to the family of the elderly victim.

The Federal Nursing Home Reform Act requires a nursing home to provide "services and activities to attain or maintain the highest practicable physical, mental, and psycho-social well-being of each resident…" Unfortunately, this obligation isn’t being met in far too many nursing homes throughout the United States.
