Practice Areas: Lead Poisoning

It is currently illegal for a landlord to rent or lease a dwelling place to a tenant if there is lead paint at the premises. Lead was used in paint for many years since it improved the paint's durability.

If ingested, lead can cause serious learning disabilities or brain damage. Children, particularly younger children are especially susceptible to lead in paint. When paint on a wall chips and falls to the ground or is in some other way eaten by a child, that child may suffer long-term and often permanent injury. Lead paint has been illegal for about thirty years now, and landlords are generally quite familiar with that fact. However, many landlords continue to rent and/or lease out homes and apartments to unsuspecting tenants. From 1998 to 2008, the number of children in Detroit diagnosed with lead paint poisoning has decreased tremendously. However, it is still far too common. Lead paint poisoning is so serious that landlords in Detroit may actually face criminal charges for leasing properties with lead paint.
